Class Action Lawsuit Filed Against Mazda Canada
In October 2015, the law office Adams Gareau filed a class action request against Mazda Canada and its SKYACTIV engines. On May 18, the Superior Court authorized the request, which covers 2012 to 2014 model-year Mazda3 cars equipped with this engine.
The plaintiff, Katia Grand-Maison, claims the real-world fuel economy of her 2012 Mazda3 is much higher than what was announced in the manufacturer’s advertising campaigns.
When the new SKYACTIV engine was introduced in 2012 as an option in the Mazda3 sedan and hatchback, Mazda Canada announced its fuel economy being as low as 4.9 L/100 km. Ms. Grand-Maison’s 2012 Mazda3 GS-SKY is said to consume 73.58% more than the official ratings.
The plaintiff is asking to be reimbursed for the difference paid between the SKYACTIV engine and the base 2.0L engine, which she claims amounts to $3,700. According to Mazda Canada’s 2012 model year price list, the Mazda3 GS had a base MSRP of $18,495, while the GS-SKY version equipped with the SKYACTIV engine was sold from $19,345, a difference of 850 $.
The class action lawsuit is also seeking to force Mazda Canada to reimburse the difference in cost between the car’s announced fuel economy and its real-world average, in addition to paying $500 in punitive damages to each member involved in the class action.
